Summer Of Rewards Sweepstakes Terms (“OFFICIAL RULES”)

2023 SUMMER OF REWARDS SWEEPSTAKES AND RULES (“OFFICIAL RULES”)

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR TO WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

The MOD Pizza Summer of Rewards Sweepstakes (“Sweepstakes”) is sponsored and administered by MOD Super Fast Pizza, LLC (on behalf of itself and its affiliate entities, “Sponsor” or “MOD Pizza”).
The Sweepstakes is governed by these Official Rules. By participating in the Sweepstakes, each Entrant (defined below) agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Sweepstakes, as determined by MOD Pizza and its agents, are final in all respects. The Sweepstakes is subject to all federal, state and local law and regulations, and is void where prohibited by law. The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with any entity other than Sponsor.

SWEEPSTAKES PERIOD
The Sweepstakes begins at 9:00 a.m. PT on August 14, 2023 and ends at 11:59 p.m. PT on September 10, 2023 (“Sweepstakes Period”). All entries must be submitted during the Sweepstakes Period.

ELIGIBILITY
The Sweepstakes is open only to participants who meet the following criteria:

(1)are eighteen (18) years of age or older;
(2)are legal residents of the United States;
(3)have internet access and a valid MOD Rewards® account at the time of entry (see https://modpizza.com/rewards-terms/).

Entrants must submit all required information to be eligible to win. Employees, officers and directors of MOD Pizza and their respective parents, subsidiaries, agents and suppliers, as well as members of their immediate families (defined as parents, spouses, children, siblings and grandparents) and individuals living in the same household as those individuals are not eligible to participate. Sponsor has the right to verify the eligibility and identity of each Entrant.

THE SWEEPSTAKES
There are two (2) ways to participate in the Sweepstakes:

Purchase a Qualifying Order using your MOD Rewards® account: During the Sweepstakes Period, place a qualifying order (subject to availability and additional terms) while logged in to your MOD Rewards® account on either the MOD app or www.modpizza.com or scan your MOD Rewards® QR code in-store; or
Enter without Making a Purchase: During the Sweepstakes Period, to enter without making a purchase, visit https://modpizza.com/summer-rewards-sweepstakes-entry/ and follow the links and instructions to complete and submit the entry form. The email address used on the entry form must be associated with a valid MOD Rewards® account.

Each entry satisfying the above requirements shall be considered an “Entry,” and the person submitting the Entry, the (“Entrant”). Entrants may make a maximum of one (1) Entry regardless of Entry method. Sponsor may, in its sole discretion, disqualify any entry it determines to be unlawful, or in violation of these Official Rules. Entrants must submit all required information to be eligible to win.

PRIZES

One (1) Grand Prize Winner will receive a Reward in the form of a credit to the Winner’s MOD Rewards® account each week reflecting the value of one (1) MOD-size pizza, for thirty (30) years. The Reward will expire at the end of the week in which it is issued, at which time a new Reward will be issued and loaded to the Winner’s MOD Rewards® account. Unredeemed Rewards will expire and not carried over into future periods. No refunds or credits will be issued for unredeemed Rewards. Terms and conditions apply to the Reward: valid at locations that participate in MOD Rewards®, cannot be combined with other offers or discounts, additional charge for alternative crusts, and does not apply to Pizza Salads. Approximate Retail Value of entire Grand Prize (“ARV”): $18,000.

At any time during the 30-year period, Sponsor may, in its sole discretion, pay the remaining balance of unissued Rewards to the Grand Prize winner as a cash payment, in full satisfaction of the Grand Prize award.

Three (3) Second Prize Winners will receive a Reward in the form of a credit to the Winner’s MOD Rewards® account each week reflecting the value of one (1) MOD-size pizza for one year. The Reward will expire at the end of the week in which it is issued, at which time a new Reward will be issued and loaded to the Winner’s MOD Rewards® account. Unredeemed Rewards will expire and not carried over into future periods. No refunds or credits will be issued for unredeemed Rewards. Terms and conditions apply to the Reward: valid at locations that participate in MOD Rewards®, cannot be combined with other offers or discounts, additional charge for alternative crusts, and does not apply to Pizza Salads.

At any time during the one-year period, Sponsor may pay the remaining credit balance to the winner as a cash payment, to be reasonably determined by Sponsor, in satisfaction of the prize award. Approximate Retail Value (“ARV”): $575.

One-hundred (100) Third Prize winners will receive a Reward in the form of a credit to the Winner’s MOD Rewards® account for a free MOD-size pizza. The Reward expires after 30 days. No refunds or credits will be issued for unredeemed Rewards. Terms and conditions apply to the Reward: valid at locations that participate in MOD Rewards®, cannot be combined with other offers or discounts, additional charge for alternative crusts, and does not apply to Pizza Salads. Approximate Retail Value (“ARV”): $10.

One hundred and fifty (150) Fourth Prize winners will b receive a $5 Reward in their MOD Rewards® account. The Reward expires after 30 days. No refunds or credits will be issued for unredeemed Rewards. Terms and conditions apply to the Reward: valid at locations that participate in MOD Rewards®, cannot be combined with other offers or discounts, and cannot be used for Gift Cards or alcoholic beverages. Approximate Retail Value (“ARV”): $5.

Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the respective prize winner. No refunds or exchanges. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE SOLELY THE RESPONSIBILITY OF THE WINNER.

WINNER SELECTION AND NOTIFICATION; ODDS OF WINNING

Within ten (10) days following the end of the Sweepstakes Period, MOD Pizza (or its designee) shall select one (1) Grand Prize Winner, three (3) Second Prize Winners, one-hundred (100) Third Prize Winners and one hundred and fifty (150) Fourth Prize Winners at random, from among all Entrants who submitted an eligible Entry during the Sweepstakes Period.

Odds of winning depend on the number of eligible Entries received.

MOD Pizza will notify potential winners through email using the email address associated with their MOD Rewards® account. Each entrant is responsible for keeping his/her MOD Rewards® account current and accurate, as applicable, for prize notification and receipt or other communications related to this Sweepstakes. If a selected prizewinner does not respond to the winner notification within three (3) days, or is otherwise deemed ineligible, that potential prizewinner shall forfeit the prize and Sponsor may select an alternate winner from among other eligible entries. Upon the request of MOD Pizza, the potential winner may be required to return an Affidavit of Eligibility, Consent, Release and Prize Acceptance Form and IRS W-9 form. If a potential winner fails to comply with these Official Rules, that potential winner will be disqualified.

ADDITIONAL LIMITATIONS
All prizes are non-transferable. No substitution or cash equivalent of prizes is permitted except in Sponsor’s sole discretion. MOD Pizza and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Sweepstakes, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Sweepstakes is unlawful and subject to possible legal action by MOD Pizza. MOD Pizza reserves the right to terminate, suspend or amend the Sweepstakes at any time in its sole discretion with or without notice. In the event of any tampering, unauthorized intervention or other unintended event impacts the integrity or administration of the Sweepstakes, MOD Pizza reserves the right to void suspect Entries at issue. MOD Pizza and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise. Entries must be appropriate for a public audience as determined in MOD Pizza’s sole discretion. Entries that in MOD Pizza’s sole discretion contain any form of vulgarity, nudity, profanity or inappropriate behavior; otherwise appear to duplicate other submitted entries; contain trademarks, logos, or trade dress owned by others, without permission; contain personal identification information; contain copyrighted materials owned by others; and/or violate any law, will be deemed invalid. Such Entries will be also void if inconsistent with Sponsors brand, in Sponsor’s sole discretion. If any entrant is found to be ineligible, or cannot or does not comply with these Official Rules, the entrant will be disqualified, any prizes will be forfeited and an alternate potential winner will be selected.

INDEMNIFICATION AND LIMITATION OF LIABILITY

BY ENTERING THE SWEEPSTAKES, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS MOD PIZZA AND EACH OF THEIR AFFILIATES, SUBSIDIARY COMPANIES, ADVERTISING AND PROMOTIONAL AGENCIES, AND EACH OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS (THE “RELEASED PARTIES”) FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE. THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR, SHALL NOT BE LIABLE FOR, AND HEREBY DISCLAIM (TO THE FULLEST EXTENT PERMITTED BY LAW), ALL LIABILITY ARISING FROM OR RELATING TO: (I) LATE OR INCOMPLETE ENTRIES; (II) TELEPHONE, ELECTRONIC, HARDWARE OR SOFTWARE PROGRAM, NETWORK, INTERNET, COMPUTER OR OTHER MALFUNCTIONS, FAILURES, OR DIFFICULTIES OF ANY KIND, WHETHER HUMAN OR TECHNICAL; (III) FAILED, INCOMPLETE, GARBLED, OR DELAYED COMPUTER OR E-MAIL TRANSMISSIONS; (IV) ANY CONDITION CAUSED BY EVENTS BEYOND THE CONTROL OF THE SPONSOR; (V) ANY INJURIES, LOSSES, OR DAMAGES OF ANY KIND ARISING IN CONNECTION WITH OR AS A RESULT OF THE PRIZE, OR ACCEPTANCE, POSSESSION, OR USE OF THE PRIZE, OR FROM PARTICIPATION IN THE SWEEPSTAKES; (VI) ANY PRINTING OR TYPOGRAPHICAL ERRORS IN ANY MATERIALS ASSOCIATED WITH THE PROMOTION; OR (VII) DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE SWEEPSTAKES.

GOVERNING LAW

This Sweepstakes shall be governed by the State of Washington law.

PRIVACY
By entering the Sweepstakes, you are providing your information to MOD Pizza. MOD Pizza will use your information to administer the Sweepstakes and for other purposes as described in MOD Pizza’s Privacy Policy located at www.MODPizza.com/privacy-policy.

PUBLICITY
By participating, each Entrant grants MOD Pizza permission to use Entrant’s name, likeness or comments, entry submissions (including without limitation, writings, photographs and videos), for publicity purposes without payment of additional consideration, except where prohibited by law.

COPIES OF THE RULES AND WHO WON
Requests for copies of these Official Rules or a winner’s list may be sent to MOD Super Fast Pizza, LLC, Attn: “MOD Pizza Free Pizza for Life Sweepstakes” at the address detailed below, provided such requests shall be subject to applicable laws and regulations. All requests must be received no later than sixty (60) days following the end of Sweepstakes Period.

NOTICE
Sponsor reserves the right to prosecute and seek damages against any individual who attempts to undermine the operation of the Sweepstakes in violation of these Official Rules and/or criminal and/or civil law.
