Our efforts are focused at the local level, in the neighborhoods where we live and work. To be considered, your organization needs to be a non-profit and located near a MOD Pizza.

PREAMBLE
MOD PIZZA COMMUNITY FUNDRAISER PROGRAM TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern participation in the MOD Pizza Community Fundraiser Program (“Program”) operated by MOD Super Fast Pizza, LLC (“MOD Pizza,” “we,” “us,” or “our”), 3245 146th Pl SE, Suite 100, Bellevue, WA 98007. By submitting a fundraiser request or participating in the Program, the participating organization (“Organization”) and its authorized representative (“you”) agree to be bound by these Terms.
- PROGRAM OVERVIEW
The Program allows eligible nonprofit organizations to host fundraising events at participating MOD Pizza locations, including both company-owned and franchised locations. For each approved fundraiser event, MOD Pizza will donate twenty percent (20%) of qualifying food and beverage sales generated during the Organization’s designated fundraiser event to the Organization, subject to the terms and conditions set forth herein.
- ELIGIBILITY
The Program is open to U.S.-based 501(c)(3) nonprofit organizations located within the service area of a participating MOD Pizza restaurant location. The individual submitting the fundraiser request on behalf of the Organization must be at least eighteen (18) years old and authorized to act on behalf of the Organization. MOD Pizza reserves the right to verify eligibility at any time, including by requesting proof of 501(c)(3) status and authorized representative status. MOD Pizza may, in its sole discretion, decline any fundraiser request.
- HOW TO PARTICIPATE
To request a fundraiser event, visit https://www.modpizza.com/fundraisers/ and submit the required information, including the Organization’s name, contact information, tax-exempt identification number, and preferred event date(s). Fundraiser requests are subject to approval by MOD Pizza. Upon approval, the Organization will receive instructions for creating a custom flyer and a unique code (“Force4Good Code”) for use with online and in-app orders.
- FUNDRAISER EVENT
Each fundraiser event is valid only on the date(s) and at the MOD Pizza location(s) identified in the Organization’s approved fundraiser request. The Organization is responsible for promoting its fundraiser event to its supporters and community. Supporters may participate by (a) dining in at the designated MOD Pizza location and mentioning the Organization’s name at the point of sale, or (b) placing an online or in-app order using the Organization’s Force4Good Code. Sales not properly identified through one of these methods will not be attributed to the Organization’s fundraiser event.
- QUALIFYING SALES AND DONATION CALCULATION
MOD Pizza will donate twenty percent (20%) of net eligible sales generated during the Organization’s fundraiser event. “Net eligible sales” means total food and beverage sales at the designated MOD Pizza location that are attributable to the Organization’s fundraiser event, excluding the following:
- sales tax;
- gift card purchases;
- retail merchandise sales;
- refunds, voids, and complimentary items.
MOD Pizza’s records of net eligible sales are final and binding. The donation is calculated based on pre-tax food and beverage revenue only.
- DONATION PAYMENT
- DONATION PAYMENT. Donations are processed after the fundraiser event concludes and are typically delivered to the Organization within four to six (4-6) weeks following the event date in the form of a check made payable to the Organization. MOD Pizza is not responsible for delays caused by incomplete or inaccurate Organization information. If a donation check is returned as undeliverable, MOD Pizza will make reasonable efforts to contact the Organization. Unclaimed donations will be handled in accordancewith applicable state unclaimed property laws.
- FLYER AND PROMOTIONAL MATERIALS
Organizations may create and distribute custom flyers to promote their fundraiser events using materials and templates provided by MOD Pizza. All flyers must accurately represent the Program and may not be altered in any way that misrepresents MOD Pizza, the Program, or the terms of the fundraiser.
Flyers may not be distributed in or immediately adjacent to a MOD Pizza restaurant location. Distribution of flyers in or near the restaurant will void the fundraiser event, and no donation will be made.
MOD Pizza reserves the right to approve or reject any promotional materials created by the Organization in connection with the Program.
- ONLINE AND IN-APP ORDERS
For online orders placed at www.modpizza.com or through the MOD Pizza app, supporters must enter the Organization’s Force4Good Code at checkout. Only pick-up orders placed online or through the MOD Pizza app are eligible for the Program. Online and in-app orders that do not include the Force4Good Code will not be attributed to the Organization’s fundraiser event and will not be included in the donation calculation.
- DELIVERY ORDERS
Delivery orders are eligible for the Program only if the customer’s delivery address falls within the delivery boundary of the designated MOD Pizza location identified in the Organization’s approved fundraiser request.
Delivery orders placed through third-party delivery platforms (e.g., DoorDash, Uber Eats, Grubhub) are not eligible for the Program and will not be included in the donation calculation, unless otherwise specified by MOD Pizza in writing or through instructions provided to the Organization at the time of fundraiser approval.
- PROMOTIONAL PERIODS
From time to time, MOD Pizza may offer additional promotional opportunities in connection with the Program, such as contests, sweepstakes, or bonus donation periods. Participation in any such promotion is subject to separate official rules and terms, which will be made available at https://www.modpizza.com/fundraisers/ or as otherwise specified. In the event of a conflict between these Terms and the official rules of a specific promotion, the official rules of that promotion will control with respect to the promotional component.
- PROGRAM MODIFICATIONS AND TERMINATION
MOD Pizza reserves the right to modify, suspend, or terminate the Program, in whole or in part, at any time and for any reason, with or without notice. Any modification or termination will not affect donations already earned for completed fundraiser events. MOD Pizza also reserves the right to change the donation percentage, eligibility requirements, or any other aspect of the Program at its discretion. Continued participation in the Program after any modification constitutes acceptance of the modified Terms.
- LIMITATION OF LIABILITY
To the fullest extent permitted by law, MOD Pizza, its parent companies, subsidiaries, affiliates, franchisees, and their respective officers, directors, employees, agents, and representatives will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the Program or these Terms, including any loss of expected donations, regardless of the theory of liability. MOD Pizza’s total liability to any Organization under these Terms will not exceed the amount of the donation actually earned by that Organization for the applicable fundraiser event. MOD Pizza is not responsible for technical failures, system outages, or errors that may affect the processing of orders, attribution of sales, or calculation of donations.
- PRIVACY
- PRIVACY. Information collected from Organizations and their representatives in connection with the Program will be used to administer the Program and communicate with Organizations about their fundraiser events. MOD Pizza’s collection, use, and disclosure of personal information is governed by the MOD Pizza Privacy Policy, available at https://modpizza.com/privacy-policy/.
- GOVERNING LAW; ENTIRE AGREEMENT; CONTACT INFORMATION
- Disputes and Governing Law. These Terms and any disputes relating to the Program are governed by the laws of the State of Washington, without regard to conflict of laws principles. Except where prohibited by law, each Organization and its authorized representative agrees that: (a) any dispute, claim, or cause of action arising out of or relating to these Terms or the Program will be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules then in effect; (b) any such arbitration will take place in King County, Washington; (c) the Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision; and (d) judgment on the arbitration award may be entered in any court of competent jurisdiction. To the extent arbitration is found unenforceable, each Organization consents to the exclusive jurisdiction and venue of the state and federal courts located in King County, Washington.THE PARTIES WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING RELATING TO THE PROGRAM.
- Entire Agreement. These Terms constitute the entire agreement between MOD Pizza and the Organization with respect to the Program, except as supplemented by the official rules of any specific promotion offered in connection with the Program. MOD Pizza’s failure to enforce any provision of these Terms does not constitute a waiver of that provision.
