MOD PIZZA #NATIONALPIDAY SWEEPSTAKES AND RULES (“OFFICIAL RULES”)

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR TO WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

The MOD Pizza #NationalPiDay Sweepstakes (“Sweepstakes”) is sponsored and administered by MOD Super Fast Pizza, LLC (on behalf of itself and its affiliate entities, “Sponsor” or “MOD Pizza”).
The Sweepstakes is governed by these Official Rules. By participating in the Sweepstakes, each Entrant (defined below) agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Sweepstakes, as determined by MOD Pizza and its agents, are final in all respects. The Sweepstakes is subject to all federal, state and local law and regulations, and is void where prohibited by law. The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with any entity other than Sponsor.

SWEEPSTAKES PERIOD
The Submission Period begins at 8:00 a.m. PT on March 14, 2022 and ends at 11:59 p.m. PT on March 14, 2022 (“Sweepstakes Period”). All entries must be submitted during the Sweepstakes Period.

ELIGIBILITY
The Sweepstakes is open only to participants who meet the following criteria (“Entrants”):

(1) are thirteen (13) years of age or older;
(2) are legal residents of the United States;
(3) have Internet access and a valid Twitter account or Instagram account at the time of entry.

Any Entrant who is under 18 years of age or otherwise under the legal age of majority in the jurisdiction in which the Entrant resides (a “Minor”) must obtain permission to enter from his or her parent or legal guardian, and the agreement of the parent or legal guardian to these Official Rules, prior to entry.

Entrants must submit all required information to be eligible to win. Employees, officers and directors of MOD Pizza and their respective parents, subsidiaries, agents and suppliers, as well as members of their immediate families (defined as parents, spouses, children, siblings and grandparents) and individuals living in the same household as those individuals are not eligible to enter or win. Sponsor has the right to verify the eligibility of each entrant.

HOW TO ENTER THE SWEEPSTAKES
There are two ways to enter in the Sweepstakes (“Entry or Entries”):

1. With Twitter:
1. Follow @modpizza on Twitter; and
2. Quote tweet the unique Pi Day tweet with your answer to the prompt “What do you think Pi Day in the year 3141 will look like?”
2. With Instagram:
1. Follow @modpizza on Instagram; and
2. Comment on a unique @modpizza Instagram Pi Day post with your answer to the prompt “What do you think Pi Day in the year 3141 will look like?”

You will receive up to one (1) entry by each method of participation for a total of two (2) Entries per person. Sponsor may disqualify your Entry if it determines that it finds it to be unlawful, or in violation of these Official Rules. Twitter and Instagram are not associated with and does not endorse this Sweepstakes.

PRIZES
Ten (10) Grand Prizes will be awarded. Each Grand Prize winner will receive a gift card from MOD Pizza in the amount of three hundred and forteen dollars ($314) that may be used at participating MOD Pizza locations (ARV=$314). Gift card does not expire. Terms and conditions may apply, as noted on gift card. Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the respective prize winner. No refunds or exchanges. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE SOLELY THE RESPONSIBILITY OF THE WINNER.

WINNER SELECTION
Within 10 days following the end of the Sweepstakes Period, MOD Pizza will select ten (10) winners at random from all Entrants who submitted eligible Entries.

Odds of Winning.
Odds of winning depend on the number of eligible Entries received during each Sweepstakes Period.

Potential Winner Notification.
MOD Pizza will notify potential winners through direct message on Instagram or Twitter using their Instagram or Twitter username. Each Entrant is responsible for keeping his/her Twitter or Instagram account set on public and current and accurate, as applicable, for prize notification and receipt or other communications related to this Sweepstakes. If Sponsor cannot reach the potential prizewinner within seven (7) days, using the contact information provided at the time of entry, that potential prizewinner shall forfeit the prize and Sponsor may select an alternate winner. Upon the request of MOD Pizza, the potential winner may be required to return an Affidavit of Eligibility, Consent, Release and Prize Acceptance Form and IRS W-9 form. If a potential winner fails to comply with these Official Rules, that potential winner will be disqualified.

ADDITIONAL LIMITATIONS
Prizes are non-transferable. No substitution or cash equivalent of prizes is permitted. Except in Sponsor’s sole discretion. MOD Pizza and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Sweepstakes, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Sweepstakes is unlawful and subject to possible legal action by MOD Pizza. MOD Pizza reserves the right to terminate, suspend or amend the Sweepstakes in its sole discretion, without notice. In the event any tampering or unauthorized intervention may have occurred, MOD Pizza reserves the right to void suspect entries at issue. MOD Pizza and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise. Entries must be appropriate for a public audience as determined in MOD Pizza’s sole discretion. Entries that in MOD Pizza’s sole discretion contain any form of vulgarity, nudity, profanity or inappropriate behavior; otherwise appear to duplicate other submitted entries; contain trademarks, logos, or trade dress owned by others, without permission; contain personal identification information; contain copyrighted materials owned by others; and/or violate any law, will be deemed invalid. Such Entries will be also void if inconsistent with Sponsors brand, in Sponsor’s sole discretion. If any Entry is found to be ineligible, or cannot or does not comply with these Official Rules, the entrant will be disqualified, any prizes will be forfeited and an alternate potential winner will be selected.

INDEMNIFICATION AND LIMITATION OF LIABILITY.
BY ENTERING THE SWEEPSTAKES, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS MOD PIZZA, TWITTER, INSTAGRAM, AND EACH OF THEIR AFFILIATES, SUBSIDIARY COMPANIES, ADVERTISING AND PROMOTIONAL AGENCIES, AND EACH OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS (THE “RELEASED PARTIES”) FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE. THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR, SHALL NOT BE LIABLE FOR, AND HEREBY DISCLAIM (TO THE FULLEST EXTENT PERMITTED BY LAW), ALL LIABILITY ARISING FROM OR RELATING TO: (I) LATE OR INCOMPLETE ENTRIES; (II) TELEPHONE, ELECTRONIC, HARDWARE OR SOFTWARE PROGRAM, NETWORK, INTERNET, COMPUTER OR OTHER MALFUNCTIONS, FAILURES, OR DIFFICULTIES OF ANY KIND, WHETHER HUMAN OR TECHNICAL; (III) FAILED, INCOMPLETE, GARBLED, OR DELAYED COMPUTER OR E-MAIL TRANSMISSIONS; (IV) ANY CONDITION CAUSED BY EVENTS BEYOND THE CONTROL OF THE SPONSOR; (V) ANY INJURIES, LOSSES, OR DAMAGES OF ANY KIND ARISING IN CONNECTION WITH OR AS A RESULT OF THE PRIZE, OR ACCEPTANCE, POSSESSION, OR USE OF THE PRIZE, OR FROM PARTICIPATION IN THE SWEEPSTAKES; (VI) ANY PRINTING OR TYPOGRAPHICAL ERRORS IN ANY MATERIALS ASSOCIATED WITH THE PROMOTION; OR (VII) DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE SWEEPSTAKES.

GOVERNING LAW

This Sweepstakes shall be governed by the State of Washington law for any disputes involving residents of the United States.

PRIVACY
By entering the Sweepstakes, you are providing your information to MOD Pizza. MOD Pizza will use your information to administer the Sweepstakes and for other purposes as described in MOD Pizza’s Privacy Policy located at www.MODPizza.com/privacy-policy.

PUBLICITY
By participating, each Entrant (and if Entrant is a Minor, his or her parent or legal guardian) grants MOD Pizza permission to use Entrant’s name, likeness or comments, entry submissions (including without limitation, writings, photographs and videos), for publicity purposes without payment of additional consideration, except where prohibited by law.

COPIES OF THE RULES AND WHO WON
Requests for copies of these Official Rules or a winner’s list may be sent to MOD Super Fast Pizza, LLC, Attn: “MOD Pizza #NationalPiDay Sweepstakes” at the address detailed below, provided such requests shall be subject to applicable laws and regulations. All requests must be received no later than sixty (60) days following the end of Sweepstakes Period.
