MOD PIZZA SUPER FAMILY FUN CHALLENGE AND RULES (“OFFICIAL RULES”)

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR TO WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

The MOD Super Family Fun Challenge (“Challenge”) is sponsored and administered by MOD Super Fast Pizza, LLC (on behalf of itself and its affiliate entities, “Sponsor” or “MOD Pizza”).
The Challenge is governed by these Official Rules. By participating in the Challenge, each Participant (defined below) agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Challenge, as determined by MOD Pizza and its agents, are final in all respects. The Challenge is subject to all federal, state and local law and regulations, and is void where prohibited by law. The Challenge is in no way sponsored, endorsed or administered by, or associated with any entity other than MOD Pizza.

CHALLENGE PERIOD
The Challenge begins at 8:00 a.m. PT on August 29, 2022 and closes at 11:59 p.m. PT on November 14, 2022 (the “Challenge Period”). All entries must be submitted during the Challenge Period.

ELIGIBILITY
The Challenge is open only to participants who meet the following criteria (“Participants”):

(1)are thirteen (13) years of age or older;
(2)are legal residents of the United States;
(3)have internet access and a valid TikTok or Instagram account at the time of entry.

Any Participant who is under 18 years of age or otherwise under the legal age of majority in the jurisdiction in which the Participant resides (a “Minor”) must obtain permission to enter from his or her parent or legal guardian, and the agreement of the parent or legal guardian to these Official Rules, prior to entry.

Employees, officers and directors of MOD Pizza and their respective parents, subsidiaries, agents and suppliers, as well as members of their immediate families (defined as parents, spouses, children, siblings and grandparents) and individuals living in the same household as those individuals are not eligible to enter or win. Sponsor has the right to verify the eligibility of each Participant.

HOW TO ENTER
In order to enter the Challenge, Participants create a video, share a photo or tell a story on TikTok or Instagram telling MOD why your family is the most fun family in the country and use the hashtag #MODSuperFunFamilyContest in the caption area during the Challenge Period (“Entry”). Each Participant may make a maximum of one (1) Entry.
The Entry must not contain material that is inappropriate, indecent, obscene, hateful, tortuous, defamatory, slanderous, libelous or political in nature. The Entry must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age. The Entry must not contain material that violates or infringes any third party’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement. MOD Pizza may disqualify your entry if it determines that it finds it to be unlawful, or in violation of these Official Rules. Participants must submit all required information to be eligible to win.

PRIZES
One (1) Grand Prize winner will be awarded for the Challenge Period. The Grand Prize winner will receive a free vacation awarded in the form of a cash prize in the amount of five thousand-five dollars ($5,000). Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the respective prize winner. No refunds or exchanges. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE SOLELY THE RESPONSIBILITY OF THE WINNER.

WINNER SELECTION
Within 30 days following the end of the Challenge Period, MOD Pizza shall select 1 Grand Prize winner from Participants who successfully complete the Challenge, based on a Participant’s creativity, storytelling ability, and overall quality of content, each as determined by MOD Pizza in its sole discretion.

Odds of Winning.
Odds of winning depend on the number of eligible Entries received during the Entry Period.

Potential Winner Notification.
MOD Pizza will notify potential winners through their Tik Tok or Instagram account. Each Participant is responsible for keeping his/her Tik Tok or Instagram account accurate, as applicable, for prize notification and receipt or other communications related to this Challenge. If Sponsor cannot reach the potential prizewinner within 72 hours, using the contact information provided at the time of entry, that potential prizewinner shall forfeit the prize and MOD Pizza may select an alternate winner. Upon the request of MOD Pizza, the potential winner will be required to return an Affidavit of Eligibility, Consent, Release and Prize Acceptance Form and IRS W-9 form. If a potential winner fails to comply with these Official Rules, that potential winner will be disqualified.

ADDITIONAL LIMITATIONS
Prize is non-transferable. No substitution or cash equivalent of prizes is permitted. Except in Sponsor’s sole discretion. MOD Pizza and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Challenge, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Challenge is unlawful and subject to possible legal action by MOD Pizza. MOD Pizza reserves the right to terminate, suspend or amend the Challenge in its sole discretion, without notice. In the event any tampering or unauthorized intervention may have occurred, MOD Pizza reserves the right to void suspect entries at issue. MOD Pizza and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise. If any Participant is found to be ineligible, or cannot or does not comply with these Official Rules, the Participant will be disqualified, any prizes will be forfeited and an alternate potential winner will be selected.

INDEMNIFICATION AND LIMITATION OF LIABILITY.
BY ENTERING THE CHALLENGE, EACH PARTICIPANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS MOD PIZZA, TIKTOK, INSTAGRAM, AND EACH OF THEIR AFFILIATES, SUBSIDIARY COMPANIES, ADVERTISING AND PROMOTIONAL AGENCIES, AND EACH OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS (THE “RELEASED PARTIES”) FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT PARTICIPANT’S PARTICIPATION IN THE CHALLENGE AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE. THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR, SHALL NOT BE LIABLE FOR, AND HEREBY DISCLAIM (TO THE FULLEST EXTENT PERMITTED BY LAW), ALL LIABILITY ARISING FROM OR RELATING TO: (I) LATE OR INCOMPLETE ENTRIES; (II) TELEPHONE, ELECTRONIC, HARDWARE OR SOFTWARE PROGRAM, NETWORK, INTERNET, COMPUTER OR OTHER MALFUNCTIONS, FAILURES, OR DIFFICULTIES OF ANY KIND, WHETHER HUMAN OR TECHNICAL; (III) FAILED, INCOMPLETE, GARBLED, OR DELAYED COMPUTER OR E-MAIL TRANSMISSIONS; (IV) ANY CONDITION CAUSED BY EVENTS BEYOND THE CONTROL OF THE SPONSOR; (V) ANY INJURIES, LOSSES, OR DAMAGES OF ANY KIND ARISING IN CONNECTION WITH OR AS A RESULT OF THE PRIZE, OR ACCEPTANCE, POSSESSION, OR USE OF THE PRIZE, OR FROM PARTICIPATION IN THE CHALLENGE; (VI) ANY PRINTING OR TYPOGRAPHICAL ERRORS IN ANY MATERIALS ASSOCIATED WITH THE PROMOTION; OR (VII) DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE CHALLENGE.

GOVERNING LAW
This Challenge shall be governed by the State of Washington law for any disputes involving residents of the United States.

PRIVACY
By entering the Challenge, you are providing your information to MOD Pizza. MOD Pizza will use your information to administer the Challenge and for other purposes as described in MOD Pizza’s Privacy Policy located at www.MODPizza.com/privacy-policy.

PUBLICITY
By participating, each Participant (and if Participant is a Minor, his or her parent or legal guardian) grants MOD Pizza permission to use Participant’s name, address (city and state), biographical information, photos, likeness, statements and/or comments, entry submissions (including without limitation, the Tik Tok post, writings, photographs and videos), specifically for publicity purposes without payment of additional consideration, except where prohibited by law.

COPIES OF THE RULES AND WHO WON
Requests for copies of these Official Rules or a winner’s list may be sent to MOD Super Fast Pizza, LLC, Attn: “MOD Pizza Super Family Fun Challenge” at the address detailed below, provided such requests shall be subject to applicable laws and regulations. All requests must be received no later than sixty (60) days following the end of Challenge Period.

Sponsor reserves the right to prosecute and seek damages against any individual who attempts to undermine the operation of the Challenge in violation of these Official Rules and/or criminal and/or civil law.
